The protection of your personal data is of particular importance to us. We therefore process your data exclusively on the basis of the statutory provisions.

This statement describes how SYNAPTIX GmbH (“we”) processes your personal data. It is addressed to our existing and former customers, suppliers, business partners, prospects and potential future customers, as well as their respective shareholders, governing bodies and other employees. In addition, this privacy statement is addressed to data subjects as visitors to our website synaptix.at.

1.1 Existing and former customers, sales partners, prospects and their contact persons

1.1.1 Purposes of processing

We process your personal data for the following purposes:

Where we collect your personal data from you directly, providing your data is in principle voluntary. However, we may be unable to fulfil our contract, or to fulfil it completely, if you do not provide your personal data.

1.1.2 Legal bases for processing

• If you are a prospect or potential future customer, we will only process your contact details for the purpose of direct marketing by electronic mail or by telephone with your consent pursuant to Art. 6(1)(a) GDPR;
• if you are a customer or potential new customer, we process your personal data because this is necessary for the performance of the contract concluded or to be concluded with you (Art. 6(1)(b) GDPR);
• in other cases (e.g. birthday greetings) we process the data only on the basis of your consent (Art. 6(1)(a) GDPR);
• otherwise, we process your personal data on the basis of our overriding legitimate interest in achieving the purposes stated above (Art. 6(1)(f) GDPR).

1.1.3 Transfer of your personal data

Where strictly necessary for the purposes stated above, we will transfer your personal data to the following recipients:

1.1.4 Retention period

We generally store your personal data until the end of the business relationship in the course of which we collected your data, or until the expiry of the applicable statutory warranty, limitation and retention periods; beyond that, until the conclusion of any legal disputes in which the data are required as evidence. If you are a customer, former customer, prospect or potential future customer, or a contact person at any of the above, we store your personal data for marketing purposes until you object or withdraw your consent, insofar as the marketing measure is based on your consent.

If your enquiry is aimed at concluding a contract, the processing of the data is necessary in order to offer you pre-contractual services (Art. 6(1)(b) GDPR);
• otherwise, we process your personal data on the basis of our overriding legitimate interest in achieving the purposes stated above (Art. 6(1)(f) GDPR).

Where necessary for the purposes stated above, we will transfer your personal data to the following recipients:

1.2.4 Retention period

Unless more specific retention periods are stated below, we generally store your data for a period of three months. Longer storage only takes place where necessary to investigate detected attacks on our website and, beyond that, only until the expiry of relevant limitation periods, statutory retention periods or the conclusion of any legal disputes in which the data are required as evidence.

1.2.5 Specific processing operations

Server log files

When you access this website, we collect the following personal data about you, which is technically necessary for us to display the website to you:

The processing is based on our legitimate interest pursuant to Art. 6(1)(f) GDPR in improving the stability and functionality of our website. The data are not passed on or otherwise used without your consent. These access data are not analysed and are automatically overwritten no later than seven days after the end of your visit.

Newsletter

You can subscribe to our newsletter via our website. For this we need your email address and your declaration that you agree to receive the newsletter. In order to provide you with targeted information, we also collect and process information you voluntarily provide on your form of address. Once you have registered for the newsletter, we will send you a confirmation email with a link to confirm your registration. You can cancel your newsletter subscription at any time via a link in the newsletter. Your data will be stored until you withdraw your consent.

Cookies

Our website uses so-called cookies. These are small text files that are stored on your device by your browser. They do not cause any harm. We use cookies to make our website user-friendly. Some cookies remain stored on your device until you delete them. They enable us to recognise your browser on your next visit. If you do not want this, you can set up your browser to inform you about the setting of cookies and to allow this only in individual cases. Disabling cookies may limit the functionality of our website.

Web analytics

Our website uses functions of the web analytics service Google Analytics, a web analytics service of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). For this purpose, so-called “Universal Analytics” functions are used, which enable an analysis of how users use the website. The information generated in this way is transferred to the provider’s server and stored there. You can prevent this by setting up your browser so that no cookies are stored. We have concluded a corresponding data processing agreement with the provider. Your IP address is recorded but immediately pseudonymised, so that only a rough localisation is possible. The data processing is based on the statutory provisions of § 96(3) TKG (Austrian Telecommunications Act) and Art. 6(1)(f) GDPR (legitimate interest). Our legitimate interest is the improvement of our services and our website. Because the privacy of our users is important to us, user data are pseudonymised. User data are retained for 14 months. You can also prevent the collection of your data by Google Analytics on this website by clicking the link below. An opt-out cookie will be set that prevents future collection of your data when you visit this website: Disable Google Analytics globally – https://tools.google.com/dlpage/gaoptout?hl=en.

Integration of third-party services and content

We also use third-party services on our website, such as videos (Vimeo), forms or fonts (Google Fonts). These services are used on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR in optimising and properly presenting our website. In doing so, your IP address is processed, as it is necessary to display the content on this page. However, only the data strictly necessary to achieve this purpose are processed. Third-party providers may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. Pixel tags can be used to analyse information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on users’ devices and may include, among other things, technical information about the browser and operating system, referring websites, time of visit and other details about the use of our online services, and may be combined with such information from other sources.

Vimeo

We use the provider Vimeo as the platform for our videos. Vimeo may also process personal data and pass it on to third parties. For further details on data processing by Vimeo: Vimeo Inc., Attention: Legal Department, 555 West 18th Street, New York, New York 10011, USA. The privacy policy can be found at: https://vimeo.com/privacy.

Google Maps

We also use the “Google Maps” service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. In particular, the IP address and location data of users may be processed; however, these are not collected without their consent (usually given in the settings of their mobile devices). The data may be processed outside the EU/EEA. If you do not want such processing, you can opt out here: https://adssettings.google.com/authenticated.

Social media presences

In order to communicate online with our customers and prospects, to inform them about our services and to be present on social media, we maintain online presences on various social networks and platforms. In the context of this privacy statement, we would like to point out that user data may be processed outside the European Union. In addition, user data may be used for advertising purposes by the providers of these social networks. For example, the operator can store certain usage behaviour by means of cookies stored on the data subject’s computer. Based on this usage behaviour, usage profiles are created in order, for example, to display advertisements both within and outside the platform. If you as a user explicitly consent to the processing of data as described above on the respective platform (i.e. give your consent, whether by ticking a checkbox or by confirmation), the data are processed pursuant to Art. 6(1)(a) in conjunction with Art. 7 GDPR. Otherwise, we process your data in this case on the basis of our legitimate interest in effectively informing and communicating with users pursuant to Art. 6(1)(f) GDPR. You have the right to object to the respective processing (opt-out). Below we refer to the relevant information pages of the operators of these social networks. Your data subject rights can best and most effectively be asserted directly with the platform provider, as the operator of the social network has the relevant information to provide you with detailed information.

International data transfers

Some of the recipients mentioned above may be located outside Austria or may process your personal data there. The level of data protection in other countries may not correspond to that of Austria. However, we only transfer your personal data to countries for which the European Commission has decided that they have an adequate level of data protection, or we take measures to ensure that all recipients have an adequate level of data protection. For this purpose, we conclude, for example, standard contractual clauses (2010/87/EC and/or 2004/915/EC). Any agreements concluded are available on request (see point 5 below).

Your rights regarding personal data

• to request the rectification, completion or erasure of your personal data if they are incorrect or not processed lawfully,

• to request that we restrict the processing of your personal data,

• under certain circumstances, to object to the processing of your personal data or to withdraw consent previously given for the processing, whereby withdrawal does not affect the lawfulness of processing carried out before the withdrawal,

• to request data portability, insofar as you are our customer,

• to lodge a complaint with the supervisory authority if you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been infringed. In Austria, this is the Austrian Data Protection Authority (Datenschutzbehörde) (Wickenburggasse 8-10, 1080 Wien, email: dsb@dsb.gv.at).

Privacy statement: Google AdSense

This website uses Google AdSense, an online advertising service of Google Inc., USA (“Google”). Google AdSense uses so-called “cookies” (text files) that are stored on your computer and enable an analysis of your use of the website. Google AdSense also uses so-called “web beacons” (small invisible graphics) to collect information. Through the use of web beacons, simple actions such as visitor traffic on the website can be recorded and collected. The information generated by the cookie and/or web beacon about your use of this website (including your IP address) is transmitted to a Google server in the USA and stored there. Google will use this information to evaluate your use of the website with regard to the advertisements, to compile reports on website activity and advertisements for website operators, and to provide other services related to website and internet usage. Google may also transfer this information to third parties where required by law or where third parties process these data on Google’s behalf. Google will under no circumstances associate your IP address with other Google data. You can prevent cookies from being stored on your hard drive and web beacons from being displayed by selecting “do not accept cookies” in your browser settings (in MS Internet Explorer under “Tools – Internet Options – Privacy – Settings”; in Firefox under “Tools – Options – Privacy – Cookies”); however, please note that in this case you may not be able to use all functions of this website to their full extent. By using this website, you consent to the processing of data collected about you by Google in the manner and for the purpose described above.

Privacy statement: cookies

This program stores cookies on your hard drive that record whether or not the sidebar should be displayed. By using this website, you consent to the storage of this cookie.

Privacy statement: Google Analytics

This website uses Google Analytics, a web analytics service of Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, your IP address will first be truncated by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services related to website and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You can prevent the storage of cookies by selecting the appropriate settings in your browser software; however, please note that in this case you may not be able to use all functions of this website to their full extent. You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) by Google, as well as the processing of these data by Google, by downloading and installing the browser plug-in available at the following link (http://tools.google.com/dlpage/gaoptout?hl=en).

Further information on terms of use and data protection can be found at http://www.google.com/analytics/terms/gb.html and https://policies.google.com/. Please note that on this website Google Analytics has been extended by the code “anonymizeIp” to ensure anonymised collection of IP addresses (so-called IP masking).
